On draft legislation and draft amendments to the Criminal Code in Republika Srpska that threaten fundamental rights and democratic values

The draft legislation submitted into legislative procedure by the Republika Srpska Government that places additional restrictions on the work of civil society, as well as draft amendments to the Republika Srpska Criminal Code to remove gender identity as a protected ground, represent threats to fundamental rights and democratic values. As such, if this legislation is finally adopted and enters into force, it would place obstacles on Bosnia and Herzegovina’s path to the European Union.
The EU therefore urges the Republika Srpska Government to withdraw this legislation. The EU reiterates that there cannot be backsliding on fundamental values if Bosnia and Herzegovina aspires to a future in the European Union. It is imperative for authorities in BiH to ensure an environment that enables the effective functioning of civil society, in line with country’s international human rights obligations and EU perspective, as well as protect anti-discrimination standards.
Last week, the EU welcomed the adoption of two laws that are important for progress on the EU path. Bosnia and Herzegovina has the realistic prospect of formally opening accession negotiations with the EU in the coming months if certain conditions are met. We urge the authorities in Bosnia and Herzegovina to focus on making steps forward that would demonstrably improve the lives of citizens, and refrain from actions that undermine fundamental rights and democratic values.
